J39 running woes

Hi all, ive recently bought a Bachmann J39 and i cant get it to run properly, its very jerky/hesitant while running and tends to lurch along, Ive ran it in for a couple of hours but its no better, is there anything i should look for or is it back to the shop time :(

I emailed Hornby last week but havent had a response so far, ill try a local dealer and see what they recommend. I wouldnt mind getting it repaired if it was just a resistor or something similar but failing that ill replace it. Im stumped what to replace it with tho, i quite like the look of the Gau...

Thanks for the replies, i bought it new off eBay unboxed (split from a pack?) and im sure it was over a year ago now so looks like its time to buy a new one. I might go for a Gaugemaster panel type one as the HM is a bit boxy anyway.

Ive got a HM2000 dual track controller, last night it stopped working on one side(my inner loop) the other side (outer track) is fine.
